Terms of Service

CommsCast ("CommsCast", "we", "us", or "our") provides a communications platform that helps organizations schedule events and automatically notify their members. By creating an account or otherwise using CommsCast, you agree to these Terms of Service. If you are creating an account on behalf of an organization, you are agreeing on that organization's behalf and confirming you have the authority to do so.

1. What CommsCast does

CommsCast lets an organization ("Inner Circle") create events, invite or enroll members, and automatically send announcements and reminders by email and Telegram. It can also read an organization's own public website to help build that organization's public page, and it uses AI to help draft content, summarize information, and answer questions inside the product.

2. Accounts

Accounts are created and signed into using an emailed one-time link — there is no password to set or remember. You are responsible for keeping access to the email address on your account secure, and for anything that happens under your account. You must be at least 18 years old to create an account. CommsCast accounts are for organization administrators; it is not a consumer product for children.

3. Your organization's content

You keep ownership of the event details, member lists, messages, photos, and other content you or your organization add to CommsCast ("your content"). By adding content, you give us permission to store, process, and display it as needed to run the service — for example, sending your event announcements to your members, or showing your organization's public page to visitors. You are responsible for making sure you have the right to upload any content you add, including photos of other people.

4. Photos

Photos you add to CommsCast — whether through Telegram, the upload portal, the admin dashboard, or an optional connected Google Drive folder — are kept private to your organization by default. A photo only becomes visible on your organization's public page if an administrator specifically releases that photo to public. Until then, it is treated as insiders-only.

5. Acceptable use

You agree not to use CommsCast to:

  • Send content that is illegal, harassing, hateful, or sexually exploitative, or that violates another person's rights;
  • Upload a photo or personal information about someone without a lawful basis to do so;
  • Attempt to disrupt, overload, or gain unauthorized access to CommsCast or another organization's account or data;
  • Use the service to send unsolicited bulk messages unrelated to your organization's own events and members.

We may suspend or terminate an account that violates this section.

6. Healthcare and other regulated organizations

CommsCast is a general-purpose communications platform. It is not designed, certified, or intended to store, transmit, or process Protected Health Information ("PHI") as defined by HIPAA, and CommsCast does not sign Business Associate Agreements (BAAs). Medical, dental, mental health, and other healthcare practices are welcome to use CommsCast the same way any other organization does — scheduling events and sending non-clinical announcements and reminders to staff, patients, or members. If your organization is subject to HIPAA or a similar health-privacy law, you agree not to submit PHI, patient records, diagnoses, treatment details, or other regulated health information into CommsCast, whether in event descriptions, member records, messages, or photos. You are solely responsible for determining whether your use of CommsCast complies with HIPAA and any other law that applies to your organization, and for keeping regulated health information out of the platform.

7. AI features

Some CommsCast features — drafting event descriptions, summarizing your organization's public website, and answering questions — are powered by artificial intelligence, including third-party AI providers. AI output can be inaccurate or incomplete; you're responsible for reviewing anything AI-assisted before you rely on it or send it to your members.

8. Plans and payment

CommsCast offers a free plan and paid monthly subscription plans. Paid plans are billed in advance each month through our payment processor, Stripe. Prices and plan limits are shown on our pricing page and may change with notice. See our Refund Policy for how billing, cancellation, and refunds work.

9. Ending your account

You may stop using CommsCast, or ask us to close your account and delete your organization's data, at any time by emailing [email protected]. We may suspend or close an account that violates these Terms, breaks the law, or goes unpaid on a paid plan.

10. No warranty; limitation of liability

CommsCast is provided "as is." We work hard to keep it reliable, but we don't guarantee it will be uninterrupted or error-free. To the fullest extent the law allows, CommsCast is not liable for indirect, incidental, or consequential damages arising from your use of the service, and our total liability for any claim is limited to the amount you paid us in the three months before the claim arose.

11. Governing law

These Terms are governed by the laws of the State of Texas, United States, without regard to conflict-of-law rules.

12. Changes to these Terms

We may update these Terms as CommsCast evolves. If we make a material change, we'll update the date at the top of this page and, where practical, let account administrators know. Continuing to use CommsCast after a change takes effect means you accept the updated Terms.
